WAITING FOR JUSTICE IN MEDICAL NEGLIGENCE

Hello everyone!!!
I am Shreya Nimonkar, 41 years old married lady and mother of two kids, was previously working for a pvt co and at present am handicapped and living life with many restrictions
Approximately 4 years back (JUNE 2009)when I was facing some problems related to menses for which I consulted my family doctor .
As he was not so expert in this field he advised me to consult a gynecologist I requested him to refer a lady  gynecologist as it would be more comfortable to deal with.
Accordingly I consulted the lady who after doing some tests gave some medicines and asked to do DNC (cleaning of uterus)and then she kept me on 6 months treatment, in which I had to followup on 4th/5th day of my menses.this was continued for 5 months and after that she said there is no progress and suggested to remove uterus as otherwise there is a chance of cancer.I was shocked as I was not at all prepared for this.
My daughter was going to appear her SSC Board exams and I was not ready to disturb my family .
But the gynecologist said that this was serious and I have to do it at the earliest.
It was not possible for me to take leaves as I had already planned and informed my office for leave during my daughters exams.
On this the gynac suggested me to go for laparascopy surgery, she said not to worry  as  bills can be cleared through mediclaim  Though it is costly(70 Thousand) it is very easiest way and I can resume my routine within 2 /3 days.So we discussed and decided to go ahead with the surgery in NOVEMBER 2009. All the related tests like sonography, urine , blood etc tests were done and the surgery was done early morning around 6.30 a.m as there was load shading issue.
My husband was there with me and as I was unconscious I didnt knew what went wrong but according to my husband he said my BP was shoot up very high and they carried the surgery and the oxygen was needed as it was emergency, doctor had to do a very tough job to open the cylinder, to move it till my bed  etc etc.
Finally I was stable after few hours.I was feeling weakness and uneasiness.
Next day I got discharged from her hospital.I came home and the severe stomach pain started with hundreds of hiccups and vomiting  I was again rushed back to the hospital, where she gave some medicines saying nothing to worry this may be because of empty stomach.she instructed a proper diet.
And then this went on and on, I faced abdomen pain and gas problems and after every couple of days I kept on consulting the gynac and she kept giving me medicines and various recommending tests like blood, urine,
etc After about 1 and 1/2 month she finally asked me to consult a urologist.
Then the urologist gave me some medicines and said I had to first get rid of the gas problems and hence again the gynac refered me to a gastroenterologist  who also examined me and gave few medicines and again I was back to the urologist.
Still I could nt get rid of the pain all the way. then the urologist suggested of a CT scan
According to the report it was said that lower part of abdomen is not seen and so he refered to a specialist at  Dadar for review of the reports. I met the fellow over there and he tried to study my CT scan and he gave the same remarks, lower part of abdomen not seen'
Again I was back to the gynac, I never ever missed to give her updates as this was all started from her clinic.
She spoke to the urologist and then they decided that a stent had to be put in the ureters tube,(Gynac was present in OT of urologist.
I got admitted at the urologists hospital and a surgery was done where they put the stents in both the ureters.
I was in the hospital for few hours and had to pay a handsome bill of Rs 52 Thousand, which according to the gynac was the best charged by the urologist.
After this surgery they shifted me to the gynac's hospital as there was nothing to worry and she could handle the rest things on her own.Again I was in her hospital admitted for 2 days.
I came home but no signs of improvement in my stomach pains.It was so worst that I was unable to move and used to sit with pillow pushed in my stomach.
This followups medicines and tests were promptly carried and my husband was so particular in this as he was very much bothered for me and kids.
This continued same way and then urologist asked me to go to JASLOK for the CTScan and a specialist dr Urologist has to consulted.
Again I went to Jaslok, did the CT SCAN , met the expert Dr over there who said that he was afraid and worried that I may have lost my right kidney..
This was again a shock for us.we hurried back to urologist and gynac. Gyanc then called me to her hospital and arranged for 2 expert doctors, to see me.then gynac said that may be I am suffering from Tuberculosis,
so immediately MONTEX test was done and the reports were clear.
I was fed up with all this and one fine morning I was not able to open my eyes, I looked in to the mirror and found myself swollen. my legs, thighs, hand,face was swollen.
I started crying as I was totally unaware of what has been the complication.
I called  the urologist and found he was not available for 2 days, I then called gynac and went to see her.
She did my check up and tried to contact the urologist.but couldnt get him.so I had to wait for 2 days.
This 2 days were very worst for me as the pain and the swelling had made me to think of suicide to end this sufferings.
Finally the urologist came and in seeing me he said I v to immediately go to some big hospital like LILAVATI, HINDUJA,SAIFEE etc. On hearing this we were blank as how to arrange for the money? as we had already spent so huge amounts.We requested our family doctor to suggest some good reasonable organisation.we also consulted gynac and then finally decided to go to SION hospital.
I got admitted at Sion hospital and immedialtely a surgery was done where the stents were removed and PCN was done that, in this 2 tubes were inserted in to kidneys from back side .and hourly record was maintained of the urine, deposited in the bag.sweeling was completely gone within 2-3 days.
Then my kidney function tests were done in TATA.
After 15 days a very bid surgery was done OPEN SURGERY which was carried for 9 hours.
In this they removed the cracked ureters and cut 20 Inch of my intestine and made a tube of it and replaced it to pass urine from kidney to bladder.I was on ventilator and Dr had no hopes for me.my realtives came to see me last..
But after a day I was out of danger.The surgery was so complicated that it was very difficult to mobilise the operated part and so the stomach couldn't be closed due to the gas released in side during surgery .so they only gave rough stitches and kept it as it is for a week.
After a week again a surgery was done and final stitches were put.Slowly I  recovered  under their treatment
I was in SION hospital for 50 days completely.
My family, my daughters exam,my sons exam, my husband;s job our life was shaken and disturbed b'coz of this.
Now I have restriction to not to lift heavy things, no hurry in any stage, no jumping running to catch a train or bus, and very important I have to pass urine at the period of 2 hours.as it is artificial system and the doctors said no body could too have done this surgery as it is very rare and complicated.
I have to keep a followup with the sion hospital every 4 months, this is life time followup as to see if the operated system works well and in conditions.No long term medicines to be taken any time .
This way my life has been messed up by a gynac. who is not bothered and concern about this.
At times when I was critical, she came and met me and also after discharge from Sion, she came to see me at home.she said she do agree, it was a error, a mistake and she owes me her life and all that things she said.
we asked her to help us to overcome our expenses, which she agreed, and said she will give a proper amount and she asked for a couple of days to think .

But the next day she called me and said do whatever , she's not bothered for this and not ready to pay.


So 1 /2 year back, I v registered a complaint against her at Consumer court and Maharashtra Medical Council as well.
She never comes in court, they keep on taking next dates in consumers, at MMC they say it will take time as now  only the cases opened are of  93-94.
Am I wrong ??what was my fault ?? Is she not punishable???Why is it that she is having so guts and afraid of nothing?? Is there corruptions or fishy things in this??
Is it that if I would have died in this then only she would have compensated.
I have lost my job, my sound sleep, I v become very sensitive and lacking of confidence.
I have faith in god but the systems and governments I am afraid..
Waiting for justice and will not give up so easily!!!!
